The Registry of death coverage insurance contracts is a public registry, dependent on the Ministry of Justice whose purpose is to provide the necessary information so that possible interested parties can find out if a deceased person had contracted death insurance, as well as the insurance company with which it had been subscribed, in order to allow potential beneficiaries to contact it to verify if they appear as beneficiaries and, if applicable, claim from the insurance company the benefit derived from the contract.

Centralized management will be carried out in the General Registry of Last Will Acts of the General Directorate of Legal Security and Public Faith, which will have the status of file manager, for the purposes provided in Law 15/1999, of December 13, and before which the rights of access, rectification, cancellation and opposition provided for in said Law may be exercised.

 

The information contained in the Registry will have a presumption of truth regarding the existence of the contract, for informational purposes, unless proven otherwise.

 

What insurance contracts appear in the Registry.

The insurance contracts, the data of which must appear in the Registry, are those relating to life insurance with death coverage and accident insurance in which the contingency of the insured’s death is covered, whether in the case of individual policies or collective.

 

Excluded from the scope of the Registry:

 

The insurances that implement company pension commitments with workers and beneficiaries regulated in Royal Decree 1588/1999, of October 15.

Insurance in which, in the event of the death of the insured, the policyholder and the beneficiary coincide.

Contracts signed by mutual social security societies that act as an instrument of corporate social security, mutual societies of collegiate professionals and mutual societies whose exclusive purpose is to grant benefits or subsidies for teaching or education.

What data does the Registry contain?

Identification data of the insured person:

 

Name and surname.

Number of the National Identity Document, Tax Identification Number or number of the identity document that corresponds in each case.

Identification data of the insurance company:

 

Social denomination.

Administrative code with which it is registered in the administrative register of insurance and reinsurance entities provided for in the consolidated text of the Law on the Regulation and Supervision of Private Insurance, approved by Royal Legislative Decree 6/2004, of October 29, and its development regulations.

Tax identification code.

Identification data of the insurance contract:

 

Contract number or reference to the Regulation of Benefits of the Mutual Insurance Company, if applicable.

Coverage type.

Publicity and access to the Registry.

The Registry of Death Coverage Insurance Contracts is public and may be accessed by any person interested in obtaining information about whether a deceased person had contracted death insurance and the insurance company with which it is subscribed.

 

Access to the Registry can only be made after the death of the insured, prior accreditation of such circumstance, and provided that fifteen days have elapsed from the date of death.

 

The period during which the data will be available in the Registry will be five years counted from the date indicated in the previous paragraph. However, the data relating to contracts whose benefits have been fulfilled by the insurance entity or entities will be canceled from the Registry as soon as the body in charge of its management is notified of this circumstance by the insurance entity.

 

How to sign up for the registry?

Insurance entities that enter into or have entered into insurance contracts relating to life insurance with death coverage and accident insurance in which the contingency of the death of the insured is covered, must register in the registry to periodically send the contract information.

 

This obligation will be applicable both to Spanish insurance companies and to those domiciled in a country belonging to the European Economic Area that carry out their activity in Spain under the right of establishment or under the freedom to provide services.

 

In order to register in the registry, a document must be submitted to:
